Canada Work Visa - New Policy



As of August 28, there will be an additional step for Canadian employers wishing to hire through the Temporary Foreign Worker Program (TFWP). A new rating system will match workers registered in the Canada Job Bank with advertised positions, and employers will be required to invite candidates who have a certain number of stars in relation to the position.
The government of Canada calls this new feature its Job Match service, and the change affects both high-wage and low-wage Labour Market Impact Assessment (LMIA) applications. Employers hiring through the TFWP must first obtain a positive LMIA before a foreign worker may be hired for the position. The issuance of a LMIA serves as proof that no Canadian citizen or permanent resident was ready, willing and able to perform the job.
The Job Match services will allow employers to see anonymous profiles of registered job seekers. These profiles correspond to the skills and job requirements stated in an employer’s job posting. Each match will be rated under a system of one to five stars. The more stars received by the job seeker for the position, the greater his or her compatibility with the position.
Not all foreign workers require a LMIA. LMIA-exempt hiring situations are managed under the International Mobility Program (IMP), a broad category that includes initiatives such as the Intra-Company transfer program and recruitment through NAFTA, among others.

LMIA advertising requirements

Unless there is a way for an employer to hire a foreign worker under the IMP, and unless otherwise exempt from advertising in the preliminary process of obtaining a LMIA, employers are required to adhere to certain advertising requirements before applying for a LMIA.
As of August 28, employers, irrespective of province or territory, will be required to advertise on Job Bank and conduct at least two additional methods of recruitment that are consistent with the occupation. Employers from a province or territory with a provincial or territorial job board must use Job Bank, but may also use the provincial or territorial job board as one of the additional recruitment methods.

High-wage and low-wage positions

The LMIA process is different depending on whether the position is classified as “high-wage” or “low-wage”. Jobs in which the employee is to be paid less than the provincial/territorial median wage for the occupation are considered low-wage, while those to be paid at or above the median are considered high-wage.
Effective August 28, employers hiring in a high-wage scenario will be required to invite all job seekers matched within the first 30 days of the job advertisement on Job Bank to apply for the position if they are rated four stars or more.
Employers hiring in a low-wage scenario will be required to invite all job seekers matched within the first 30 days of the job advertisement on Job Bank to apply for the position if they are rated two stars or more.

What next?

At this time, Service Canada (the government department overseeing the LMIA process) has not stated whether employers will be required to interview job candidates who apply for the position having been invited to do so by the employer under the new system.
It should be noted that employers in certain sectors and in certain parts of the country may be exempt from the LMIA advertising requirements entirely. For example, the recently-launched Global Talent Stream allows employers in the IT/tech sector to bypass the advertising requirements and bring in workers within a matter of weeks. In addition, the province of Quebec has a facilitated list of occupations that do not require employers to advertise.
Further, some workers may obtain a work permit if their employment in Canada is deemed to bring “significant social or cultural benefit” to the country.
Other positions may not necessarily be exempt, but may have variations to the LMIA advertising requirements.
Some of these options, in addition to options under the IMP, may be reviewed by employers before they embark on the process of securing a LMIA.

The Evolution of Cybersecurity

Computer security. Network security. Information security. Cybersecurity. All of these terms are used to describe the protection of information assets. Why have there been so many changes in the way we refer to security?

Safeguarding information has been a priority for as long as people have needed to keep information secure and private. Even simple encryption techniques such as Caesar ciphers were created to ensure confidentiality. But as time and technology move forward, so do the demands of security. Today, the objective of information security is threefold, involving the critical components of confidentiality, integrity and availability (see exhibit 1.1.). All three components are concerned with the protection of information. Confidentiality means protection from unauthorized access, while integrity means protection from unauthorized modification, and availability means protection from disruptions in access.

In current discussions of security, there are references to both “cybersecurity” and “information security.” Theterms are often used interchangeably, but in reality cybersecurity is a part of information security. Marketing, vendors and analysts often use the term “cyber” too broadly, due to the increasingly complex nature of information in the digital age. Additionally, the interconnected nature of critical infrastructure systems has introduced a host of new vulnerabilities with far-reaching implications. All of these factors have influenced the shift from information security to cybersecurity. Generally, cybersecurity refers to anything intended to protect enterprises and individuals
from intentional attacks, breaches, incidents and consequences. More specifically, cybersecurity can be defined as “the protection of information assets by addressing threats to information processed, stored and transported by internetworked information systems.”

Cybersecurity and Situational Awareness

Cybersecurity plays a significant role in today’s ever-evolving cyberlandscape. New trends in mobility and connectivity present a broader range of challenges than ever before as new attacks continue to develop along with emerging technologies. Cybersecurity professionals must be informed and flexible to identify and manage potential new threats, such as advanced persistent threats (APTs), effectively. APTs are attacks by an adversary who possesses sophisticated levels of expertise and significant resources, which allow the attacker to create opportunities to achieve its objectives using multiple attack vectors.

In order to successfully protect their systems and information, cybersecurity professionals must demonstrate a high degree of situational awareness. This type of awareness takes time to cultivate, because it usually develops through experience within a specific organization. Each organization has its own distinct culture, which means that conditions vary widely from one organization to another. Therefore, it is critical for cybersecurity professionals to have an awareness of the environment in which they operate.

Central to this awareness is an understanding of key business and technology factors that affect information security. Numerous factors, both internal and external, can directly impact an organization and its security needs, including:

• Business plans and business environment
• Available information technology, security process or systems in particular

Both of these factors tend to be situational in nature, as every organization faces its own unique challenges and risk based on the nature of its business. Business environment in particular tends to drive risk decisions. For example, a small start-up company may be much more tolerant of risk than a large, well-established corporation.Therefore, it can be helpful to reference these broad criteria when evaluating the drivers affecting the security of a specific organization.

With respect to technology, there are many factors that can impact security, such as:

• Platforms and tools used
• Network connectivity (internal, third-party, public)
• Level of IT complexity
• Operational support for security
• User community and capabilities
• New or emerging security tools
When evaluating business plans and the general business environment, consider drivers, such as:
• Nature of business
• Risk tolerance
• Security profile
• Industry trends for security
• Mergers, acquisitions and partnerships
– Consider type, frequency and resulting level of integration
• Outsourcing services or providers

Although business and technology drivers cannot all be predicted with certainty, they should be anticipated reasonably and handled as efficiently as possible. Failure to anticipate key security drivers reflects an inability to effectively react to changing business circumstances, which in turn results in diminished security and missed opportunities for improvement.

Canada Visa: IT Visas Fast Track



It is only a few weeks since the Global Talent Stream was launched, and already employers in Canada’s IT/tech sector are noticing how the new initiative may help their business grow.
Companies and workers alike are attracted by the two-week work permit processing standard, which allows positions to be filled quickly. In turn, this feature of the Global Talent Stream should help businesses reach their true growth potential.
However, it should be noted that the Global Talent Stream does not replace any previously existing temporary work permit option. Rather, it has been introduced in addition to those plentiful options. As a result, businesses are weighing up which route is right for them and their employees.
“The most motivating factor of the Global Talent Stream is the quick turnaround of being able to bring someone in from the outside. It’s seamless. The turnaround to bring in a foreign worker is the same as it would be to bring in a worker from here [Canada],” says Ivan Cardona, President at Opticca, a Montreal-based consulting and technology services company that specializes in helping IT organizations align with business objectives.
“With that kind of lead time, you’re making companies like mine way more competitive. To be able to turn around a qualified resource within two weeks is an amazing ability.”
Unless a foreign worker has an open work permit, it is typically the case that he or she needs a job offer before beginning the process of obtaining a Canadian work permit.
Fortunately for these workers, Canada’s tech sector is experiencing a lengthy period of growth that shows little sign of abating. This brings about job opportunities in Canada’s largest cities, such as Toronto, Montreal, and Vancouver, as well as smaller urban centres such as Waterloo and Halifax, among others.
Although Opticca doesn’t intend on hiring under the Global Talent Stream immediately, Cardona explains that “Anybody who knows the challenges of hiring internationally should be monitoring this program, absolutely. It could change doing business in a very positive way. If I get into high growth — and we all want to — then the program becomes very interesting for me, because then at that point for every foreign worker I bring in who is highly qualified, I could bring in a junior resource from here to train.”

Other options

If applicable in their case, employers in Canada may consider bringing workers to the country as intra-company transferees or under an international trade agreement, such as NAFTA. And while employers may pursue the route of applying for a Labour Market Impact Assessment (LMIA), certain occupations may be exempt from advertising requirements in certain parts of the country. For example in Quebec, home to the tech hub that is Montreal, no advertising is required when hiring under a range of IT-related occupations.
Typically, the process of obtaining a LMIA includes a minimum advertising requirement that stipulates the length of time the ad must be posted for, as well as where it may be posted. This process can eat into a company’s time and, to some degree, its budget.
On the other hand, as the Global Talent Stream in an entirely new initiative the government will provide a more ‘hands on’ approach to program oversight. This may include more regular interaction with the employer; some employers may see this as a positive feature, while others may prefer a lesser degree of ongoing interaction with government officials.
“The government of Canada recognizes that a ‘one size fits all’ approach would not work, especially in a country and an economy as diverse as Canada’s. Consequently, a range of options are presented for employers and foreign workers looking to work in Canada,” says Attorney Daniel Levy from the Campbell Cohen law firm.
“The increased range of options means that employers and workers may need some guidance in optimizing their international hiring practices.”

Skilled Occupations Lists for 2017-18 Released

The Skilled Occupations lists for the 2017-18 program year have been released. This article explains how the new lists work and which occupations have been added and removed.

General Skilled Migration

Prior to 1 July, a single MLTSSL applied to both Employer Sponsored and General Skilled Migrationprograms, and also a single STSOL.
However, the lists are different between the two programs from 1 July and are best thought of as:
  • IFSOL: Occupations for Skilled Independent Subclass 189 visas and Family Sponsored Skilled Regional Provisional Subclass 489 visas - we refer to this as the IFSOL (Independent and Family Sponsored Occupations List) in the table below.
  • STNOL: Occupations for state and territory nominated 190 and 489 visas - referred to as the STNOL below (State/Territory Nominated Occupations List).
IFSOL and STNOL are not terms used in the Legislative Instruments, but are useful in understanding which lists apply to particular visa pathways.
6 occupations have been removed from the list for Skilled Independent and family sponsored 489 visas as compared to the pre 1 July MLTSSL. Removed occupations include Sea Transport Professionals and Psychotherapists (removed entirely) and the occupations of Production Manager (Mining) and Anaesthetists which are still available for State/Territory Nomination.
13 occupations have been removed from the approved lists entirely - these include Senior Managers, Statisticians, Economists, Mining Engineers, Engineering Professionals NEC and Chemists.
16 occupations have been added to the State/Territory Nominated list which were not previously available - these include Air Transport Professionals, ICT Support Staff, Butchers and Retail Buyers.

Employer Sponsored Visas

The 457 visa and the ENS Direct Entry Stream share the same occupations list. The list is split into MLTSSL occupations and STSOL occupations. MLTSSL occupations result in a 457 visa valid for up to 4 years, whereas the maximum duration of a 457 visa in an STSOL occupation is only 2 years.
In the table below, these occupations are listed under the ESOL (Employer Sponsored Occupations List) column and we have indicated whether they are on the MLTSSL or STSOL.
Compared to the lists prior to 1 July, 18 occupations have been removed entirely - these include marine transport professionals, psychotherapists, medical administrators and property associate professionals.
27 occupations have been added to the approved lists including R&D Managers, life scientists, air transport professionals, ICT Support roles, butchers, Music professionals, metallurgists and horse trainers.
22 occupations have been moved from the STSOL to the MLTSSL including senior management positions, environmental scientists and university lecturers. 2 occupations have moved from the MLTSSL to the STSOL.
Caveats which previously applied only to 457 visa applications will now apply to ENS Direct entry applications as well - these may specify the type of business, nature of the role or minimum salary required for approval.

Conclusion

Changes to the occupations lists have been quite major - on balance more occupations have been added than removed, but applicants in certain occupations may be adversely affected.
